TestPulse Terms and Conditions
Draft: some details on this page are still being filled in.
Effective date: 3 November 2026 Last updated: 3 November 2026
These Terms and Conditions (the "Terms") are an agreement between [Founder 1 full name] and [Founder 2 full name], based in [City, State], India, who run TestPulse at test-pulse.in ("TestPulse", "we", "us"), and the company or organisation that signs up for TestPulse (the "Customer", "you"). The person who accepts these Terms confirms that they have authority to do so for the Customer.
TestPulse is not yet a registered company. When we register one, it will take over these Terms and everything we have agreed with you in them (see section 22.2). We will tell you by email and update this page. Nothing else about your account or your data changes because of that move.
By creating an account, installing the TestPulse Chrome extension, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If the Customer has signed a separate written agreement with TestPulse (such as an order form or enterprise agreement), that agreement wins where it conflicts with these Terms.
1. Definitions
- Service: the TestPulse website and web app, the TestPulse Chrome extension, any command-line runner, APIs, and related features and support.
- Workspace: the Customer's account area in TestPulse, which contains its projects, members and content.
- User: anyone the Customer allows to use its Workspace, in any role (admin, member or viewer).
- Customer Content: everything the Customer or its Users put into or capture with the Service, including tests and recordings, saved passwords, uploaded files, run results, videos, screenshots, logs, page snapshots, bug reports, comments and settings.
- Target Website: any website or web application that a User records, tests, or raises a bug on using the Service.
- AI Output: anything produced by the Service's AI features, such as failure explanations, suggested fixes, bug titles, reproduction steps and ticket text.
2. Who can use TestPulse
- TestPulse is a business tool. It is for companies, teams and professionals, not for personal or household use.
- Each User must be at least 18 years old.
- You may not use the Service if you are barred from doing so under the laws of India or any other country that applies to you, or if you are a direct competitor using it to build a competing product.
3. Accounts and workspaces
- You must give accurate sign-up details and keep them up to date.
- Each login is for one person. Do not share logins. Invite each team member separately.
- You are responsible for everything done under your Workspace and your Users' logins, and for keeping passwords private. Tell us straight away at support@test-pulse.in if you think an account has been misused.
- Workspace admins control who can join, what role each User has, and which projects they can see. The Customer is responsible for the choices its admins make.
- We may contact the Workspace's admins about the account, billing, security or changes to the Service.
4. What the Service does
TestPulse helps software teams check that their websites work:
- Record and replay. The extension records the steps a User takes on a Target Website and replays them later, in a private Chrome window on the User's own computer, to check whether the website still behaves the same way.
- Run evidence. When a test runs, the Service can capture video, screenshots, page snapshots, console messages and network logs so your team can see what happened.
- AI suggestions. When a test fails, AI can explain the likely cause and suggest a fix. AI can also help write bug reports and tickets.
- Raise bug. Users can capture a bug on any tab with a screenshot, video, recent activity ("Rewind"), technical details and steps, then share it with their team or send it to a connected tool.
- Integrations. The Service can send bugs and failures to tools such as GitHub, GitLab, Jira and Slack.
Some features may be in beta, available only on certain plans, or still being built. We may improve, change or remove features over time. If we remove a feature that is a core part of a paid plan you have already paid for, we will tell you in advance and, if it materially reduces what you paid for, offer a pro-rata refund or credit.
5. Testing websites: your responsibility
This section matters. Please read it carefully.
- Permission to test. You may only record, test, replay or raise bugs on Target Websites that the Customer owns or is authorised to test. You confirm that you have all permissions needed from the website owner and anyone else whose rights are involved.
- Tests do real things. A replayed test acts like a real person. It clicks, types, submits forms, uploads and downloads files, and can create, change or delete real data on the Target Website. We strongly recommend running tests on test or staging servers with test accounts, not on live production systems or real customer accounts. You are responsible for the effects of any test you run.
- Your own Chrome. Tests run in a private (incognito) window in the User's own Google Chrome, using the User's own computer and internet connection. The run window can share sign-in state with other private windows the User has open. TestPulse never clears the User's cookies, cache or site storage.
- Personal data on Target Websites. Recordings, screenshots, videos, logs and bug reports can capture whatever is shown on the Target Website, including other people's personal data. The Customer is responsible for having a lawful basis to capture that data, for telling the people concerned where the law requires it, and for keeping such data out of the Service wherever it can (for example, by using test data and blacking out sensitive areas before raising a bug). Passwords and card fields are masked and encrypted automatically, but other information is not.
- Credentials. If you save a password in a test, use an account created for testing. Do not save personal passwords, production admin passwords, or accounts protected by your bank or government systems.
- No guarantee of results. Passing tests do not prove that a website has no bugs, and a failing test does not always mean the website is broken. Testing is one input to your own release decisions, which remain yours.
6. Acceptable use
You and your Users must not use the Service to:
- test, scan, scrape, or automate any website without authorisation, or get around a website's access controls, rate limits, CAPTCHAs or anti-bot measures without the owner's permission;
- carry out load testing, stress testing, denial-of-service, or any activity meant to overload or disrupt a website or network;
- break into accounts, guess passwords, or use credentials that you are not allowed to use;
- capture, store or share data you have no right to handle, including special categories of personal data, children's data, health or financial records, or payment card data, except where the law allows and you have the right protections in place;
- upload or spread malware, or anything illegal, harmful, infringing, defamatory or obscene;
- send spam or unsolicited messages through any integration;
- copy, change, reverse-engineer, decompile or try to extract the source code of the Service or the extension, except where the law expressly allows it;
- resell, rent, sublicense or offer the Service to others as your own product, or use it to build a competing product;
- test the security of the Service itself (penetration testing, vulnerability scanning) without our written permission. If you find a security problem, please report it to support@test-pulse.in;
- get around plan limits, usage limits or access controls of the Service;
- break any law, or anyone else's rights.
We may investigate suspected misuse and may suspend access (see section 13) to protect the Service, other customers or third parties.
7. Customer Content
- You own it. The Customer keeps all rights in its Customer Content. We claim no ownership of it.
- Permission for us to use it. You give TestPulse a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and display Customer Content only as needed to provide, secure and support the Service, to fix problems you report, and as required by law.
- No AI training. We do not use Customer Content to train AI models, and we do not allow our AI providers to do so.
- Your responsibility. You are responsible for your Customer Content and for having the rights needed to give us this licence.
- Retention. Some Customer Content is deleted automatically after a set time, as described in the Privacy Policy (for example, run videos, screenshots and network files after 30 days, and bug reports after 12 months). Please download anything you need to keep longer.
- Usage data. We may collect information about how the Service is used (for example, how many tests run, how often features are used, error rates) and use it in aggregated, de-identified form to run, improve and report on the Service. This never identifies the Customer, its Users or Customer Content.
8. AI features
- AI Output is produced automatically and can be incomplete, out of date or wrong. It is a suggestion, not professional advice. Review AI Output before relying on it, and especially before changing your code, raising tickets or making release decisions.
- To produce AI Output, we send the relevant parts of Customer Content (such as step names, errors, failing network requests, console errors, a trimmed page snapshot and the failure screenshot) to our AI providers, as described in the Privacy Policy. We remove secrets we can detect before sending.
- Subject to these Terms, you may use AI Output for any lawful purpose. Similar output may be generated for other customers, and we do not guarantee that AI Output is unique.
- Workspace admins can ask for AI features to be switched off for their Workspace.
- We may set daily or monthly limits on AI use.
9. Sharing and integrations
- Sharing links. Users can share bugs and recordings with links. By default, links open only for signed-in people with access to the project. If your team makes a link available to others, the Customer is responsible for who receives it. Links can be set to expire or switched off.
- Third-party tools. If your admin connects a third-party tool (such as GitHub, GitLab, Jira or Slack), you authorise us to send Customer Content to it as your team directs. Your use of that tool is governed by its own terms and privacy policy. We are not responsible for third-party tools, and they may change or stop working with TestPulse.
- Access tokens. Tokens you give us for integrations are stored encrypted and used only to perform the actions you ask for. Use tokens with the least access needed, and revoke them when you no longer need them.
10. The Chrome extension
- Subject to these Terms, we give each User a personal, non-exclusive, non-transferable, revocable licence to install and use the TestPulse extension in Google Chrome to use the Service.
- The extension needs certain browser permissions to work, including access to the websites you test and Chrome's debugging interface during runs. The Privacy Policy explains each permission.
- The extension captures data from a website only when a User records a test, runs a test or raises a bug (or, for Rewind, on websites where Rewind is switched on).
- Updates may be installed automatically through the Chrome Web Store. Some features need the latest version.
- The extension works only in Google Chrome. We do not guarantee it will work with every website, every browser setting, or alongside every other extension.
11. Plans, fees and payment
- Free plan and trials. We may offer a free plan or a free trial with limited features or usage. We may change or end a free plan or trial at any time. At the end of a trial, you must choose a paid plan to keep using paid features.
- Fees. Paid plans are billed in advance, monthly or yearly, at the price shown on our pricing page or in your order. Prices exclude taxes unless stated. Where we are required to charge tax (such as GST), we will add it to your invoice, and you are responsible for paying it.
- Automatic renewal. Paid plans renew automatically for the same period unless you cancel before the renewal date. You can cancel at any time from your account settings or by contacting us; your plan then stays active until the end of the period you have paid for.
- Seats and limits. If your plan is priced by users, projects, runs, storage or AI use, and you go over the limit, we may ask you to upgrade or charge for the extra use as shown on the pricing page.
- Price changes. We may change prices for future billing periods by giving at least 30 days' notice. The new price applies from your next renewal.
- Refunds. Fees are non-refundable, except where these Terms say otherwise, where we charged you in error, or where the law requires a refund.
- Late payment. If payment fails or is late, we may suspend paid features after giving notice and a reasonable chance to pay.
- Payment provider. Payments are processed by our payment provider, Razorpay, under its own terms.
12. Our responsibilities
- We will provide the Service with reasonable skill and care, and use reasonable technical and organisational measures to protect Customer Content, as described in the Privacy Policy.
- We will process personal data in Customer Content only on the Customer's instructions (these Terms and its use of the Service count as instructions) and as the law requires. Where the law requires a data processing agreement, our Data Processing Addendum [link] forms part of these Terms and is available on request.
- We will notify the Customer without undue delay if we become aware of a security breach affecting its Customer Content.
- We aim to keep the Service available, but it may sometimes be unavailable for maintenance, updates, or reasons outside our control. Unless a separate agreement says otherwise, we do not promise any specific uptime.
13. Suspension
We may suspend all or part of the Service, for the Customer or a User, if:
- it is needed to stop a security threat or serious harm to the Service, other customers or third parties;
- you are using the Service in breach of section 5 or 6;
- payment is overdue after notice; or
- the law or a court or authority requires it.
Where reasonable, we will give notice first and limit the suspension to what is necessary. We will restore access once the issue is fixed.
14. Ending the agreement
- By you. You may stop using the Service and close your Workspace at any time by contacting us or, where available, from your account settings. Paid fees are not refunded for the rest of the billing period, except as stated in section 11.
- By us. We may end these Terms by giving 30 days' notice. If we do this without cause during a paid period, we will refund the unused part of prepaid fees. We may end them immediately if you seriously or repeatedly break these Terms, or if the law requires it.
- What happens next. When the agreement ends, access to the Workspace stops. You may ask for a copy of your Customer Content within 30 days after the end, where an export is available. After that, we will delete Customer Content within [30] days, except where we must keep it by law. Backup copies are removed when those backups expire.
- Sections that by their nature should continue (such as 7, 15, 16, 17, 18 and 20) survive the end of these Terms.
15. Intellectual property
- TestPulse, its logo, the Service, the extension and all related software, designs and documentation belong to TestPulse or its licensors. These Terms do not transfer any of those rights to you, except the limited rights to use the Service set out here.
- Feedback. If you send us ideas, suggestions or bug reports about TestPulse, we may use them freely without paying you or naming you. This does not give us ownership of your Customer Content.
- Reference. We may name the Customer as a TestPulse customer (including its logo) in our marketing, unless the Customer tells us not to at support@test-pulse.in.
16. Confidentiality
Each party may receive non-public information from the other that is marked confidential or that a reasonable person would understand to be confidential, including Customer Content. The receiving party will use it only for the purposes of these Terms, protect it with at least reasonable care, and share it only with its staff, advisers and service providers who need to know it and are bound by similar duties. This does not cover information that is public through no fault of the receiving party, was already known to it, was received lawfully from someone else, or was developed independently. A party may disclose confidential information where the law requires, after giving notice where allowed.
17. Disclaimers
Except as expressly stated in these Terms, the Service is provided "as is" and "as available". To the extent the law allows, we disclaim all other warranties, express or implied, including fitness for a particular purpose, merchantability, non-infringement, and that the Service will be error-free or uninterrupted. In particular, we do not promise that:
- every test will replay correctly on every website, or that every bug will be found;
- AI Output will be accurate or complete;
- third-party tools, websites or Chrome itself will keep working with the Service.
You are responsible for your own release decisions and for backing up anything important.
18. Limitation of liability
- To the extent the law allows, neither party is liable to the other for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, business, goodwill or data, even if told such loss was possible.
- To the extent the law allows, each party's total liability arising from or relating to these Terms is limited to the fees the Customer paid to TestPulse in the 12 months before the event that caused the claim, or USD 100 if the Customer has paid nothing.
- These limits do not apply to: the Customer's payment obligations; a party's indemnity obligations under section 19; breach of section 6 (Acceptable use); a party's fraud, gross negligence or wilful misconduct; or any liability that cannot be limited by law.
- We are not responsible for changes, loss or damage to data on Target Websites caused by tests or recordings run by the Customer's Users, since the Customer controls what is tested and where (see section 5).
19. Indemnity
- By the Customer. The Customer will defend and hold TestPulse harmless from claims by third parties, and pay resulting damages, costs and reasonable legal fees, arising from: Customer Content; testing a Target Website without authorisation; breach of section 5 or 6; or the Customer's breach of law.
- By TestPulse. TestPulse will defend the Customer against third-party claims that the Service, as provided by us and used under these Terms, infringes that third party's intellectual property rights, and pay resulting damages and costs finally awarded. This does not apply to claims caused by Customer Content, third-party tools, or combining the Service with things we did not provide. If such a claim arises, we may change the Service so it no longer infringes, get you the right to keep using it, or end the affected part and refund prepaid fees for it.
- The party seeking protection must tell the other promptly, let it control the defence and settlement (no settlement may admit fault for the protected party without its consent), and give reasonable help.
20. Governing law and disputes
- These Terms are governed by the laws of India, without regard to conflict-of-law rules.
- Before starting formal proceedings, both parties will try in good faith to settle any dispute by discussion for 30 days after written notice.
- If not settled, the dispute will be resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement. The seat and venue of arbitration will be [City], India, and the language will be English. Subject to this, the courts of [City], India have exclusive jurisdiction.
- Either party may ask a court for urgent interim relief at any time to protect its confidential information or intellectual property.
21. Changes to these Terms
We may update these Terms from time to time. If a change is significant, we will tell Workspace admins by email or in the app at least [30] days before it takes effect. If you do not agree to the change, you may close your Workspace before it takes effect and receive a pro-rata refund of any prepaid fees for the remaining period. Continuing to use the Service after the change takes effect means you accept it.
22. General
- Whole agreement. These Terms, the Privacy Policy, any order form and any Data Processing Addendum are the entire agreement between us about the Service.
- Assignment. You may not transfer these Terms without our written consent. We may transfer them, with notice to you, to a company we set up to run TestPulse, or to a buyer of our business. The new owner will be bound by these Terms and our Privacy Policy.
- Events outside our control. Neither party is liable for delays or failures caused by events beyond its reasonable control, such as natural disasters, war, internet or hosting outages, or government action (this does not excuse payment obligations).
- Notices. We send notices to the email address of the Workspace's admins. You send notices to support@test-pulse.in.
- No waiver. If we do not enforce a right straight away, we do not give it up.
- Severability. If any part of these Terms is found unenforceable, the rest still applies, and the unenforceable part will be changed as little as needed to make it enforceable.
- Independent parties. The parties are independent contractors. Nothing in these Terms creates a partnership, agency or employment relationship.
- Export and sanctions. You will comply with all export control and sanctions laws that apply to your use of the Service.
- Language. These Terms are written in English. Any translation is for convenience only.
